Terms of Service

These Terms of Service ("Terms") govern your use of Enki, provided by Tallisa ("Tallisa", "we", "our", or "us"). By downloading, accessing, or using Enki, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Enki.

Where Apple's Standard End User License Agreement applies, these Terms supplement it. If there is a conflict about your license to the iOS app, Apple's applicable terms control.

Eligibility and accounts

You must be legally able to enter this agreement. If you are below the age of majority where you live, a parent or guardian must agree for you. You are responsible for your account, the security of your sign-in method, and activity performed through your account. Tell us promptly if you believe it has been compromised.

The service

Enki lets you capture, organize, sync, search, resurface, and create collections from content you save. Some functions use automated models to process content. Results may be incomplete or inaccurate, so you remain responsible for how you use them. Enki does not provide medical, legal, financial, or other professional advice.

We may improve, change, suspend, or discontinue features. We will take reasonable steps to avoid unnecessary disruption and provide notice where law requires it. Internet access, supported devices, and third-party services may be required for some functions.

Your content

You retain ownership of content you submit to Enki. You give Tallisa a limited, worldwide license to host, transmit, process, reproduce, and display that content only as needed to operate, secure, and improve the service for you. This license ends when the content is deleted, subject to normal backup expiry and legal retention requirements.

You must have the rights needed to save and process content. Enki does not grant you rights to third-party articles, images, videos, or other material. Your use of third-party content and links remains subject to their owners' terms and applicable law.

Acceptable use

You may not use Enki to:

• Break the law, infringe rights, or distribute unlawful, abusive, or harmful material.
• Access another person's account or data without permission.
• Probe, bypass, disable, or interfere with security, rate limits, or service operation.
• Introduce malware, automate abusive traffic, scrape the service, or resell access without permission.
• Use generated or processed output to deceive, harm, or make prohibited high-impact decisions.

Enki Plus subscriptions

Enki may offer an automatically renewing Enki Plus subscription through Apple's App Store. The price, billing period, included features, and any trial are shown before purchase. Payment is charged to your Apple Account when you confirm the purchase.

A subscription renews automatically unless you cancel it at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before that period ends. You can manage or cancel the subscription in your App Store account settings. If a trial is offered, unused trial time may be lost when you purchase a subscription where Apple permits. Refunds are handled under Apple's policies and applicable law.

App Store terms

These Terms are between you and Tallisa, not Apple. Apple is not responsible for Enki or its content and has no obligation to provide maintenance or support for it.

Your licence to the iOS app is non-transferable and covers Apple-branded devices you own or control, under the Usage Rules in the App Store Terms of Service. If the app fails to conform to a warranty that applies, you may tell Apple and Apple will refund the purchase price; beyond that refund, Apple has no warranty obligation. Any other warranty claim, loss, liability, damage, cost, or expense is Tallisa's responsibility.

Tallisa, not Apple, is responsible for handling any claim about Enki, including product liability, a failure to meet a legal or regulatory requirement, and claims under consumer protection or privacy law. Tallisa is also responsible for investigating and resolving any claim that Enki infringes someone's intellectual property.

By using Enki you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when you use Enki.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Questions, complaints, or claims about Enki can be sent to [email protected] or Tallisa, Colombo, Sri Lanka.

Intellectual property

Enki, its software, branding, design, and service content belong to Tallisa or our licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use Enki for its intended purpose under these Terms. No other rights are granted.

Suspension and termination

You may stop using Enki at any time and request account deletion. We may suspend or terminate access if you materially breach these Terms, create risk or harm, or if required by law. Where reasonable, we will give notice and an opportunity to fix the issue. Terms that by their nature should survive termination will continue to apply.

Disclaimers

To the extent permitted by law, Enki is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and continuous or error-free operation. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

Limitation of liability

To the extent permitted by law, Tallisa and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from Enki. Our total liability for claims relating to the service will not exceed the greater of the amount you paid us for Enki during the 12 months before the claim or US $50. These limits do not apply where law prohibits them.

Governing law and disputes

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law rules. Courts in Colombo, Sri Lanka will have jurisdiction, unless consumer law where you live gives you the right to bring a claim elsewhere. Before filing a formal claim, please contact us so we can try to resolve it.

Changes and contact

We may update these Terms. We will post the new effective date and provide notice of material changes where required. Continuing to use Enki after an update takes effect means you accept the revised Terms. Questions can be sent to [email protected] or Tallisa, Colombo, Sri Lanka.
